DA won't file charges against HMB police officer

No charges will be filed against a Half Moon Bay Police officer investigated for possibly withholding evidence in the case of a convicted sex offender, the San Mateo County District Attorney's Office revealed on Thursday.

Deputy District Attorney Steve Wagstaffe said that Half Moon Bay School Resource Officer Dennis Loubal was the focus of the investigation but had committed no crime while pursuing the case. He said the matter would be referred back to the police department for an internal review of Loubal's conduct.

Wagstaffe said the district attorney's office investigation revealed that Loubal knew the father of one of the juveniles who had been given inappropriate massages by Joao Pierini, the Brazilian martial arts instructor who recently pleaded no contest to sex crimes. Loubal was off-duty when the father reported the crimes to him, asking for the officer's advice. Loubal did not immediately report the case to department officials, but a short time later strongly encouraged the father to do so himself, Wagstaffe said.

Loubal has been on paid administrative leave from the department pending the result of the investigation. Police Chief Ike Ortiz was out on vacation Thursday and was unavailable to comment on internal investigation. It was not immediately clear when Loubal might be cleared for return to duty or whether he would face sanction from the department.
