Mullin promises to press forward

State Assemblyman Gene Mullin says he will continue as author and proponent of AB 1991 - legislation necessary to settle the Beachwood land dispute -- despite the loss of support from state Sen. Leland Yee.

Mullin said Friday morning that for the time being he will not seek another senator to sponsor the bill, but rather he says he plans on promoting the legislation himself in both the Assembly and Senate.

"Yee was originally the principal co-author, and if the bill gets to the Senate floor, it will need another senator's support," Mullin said. "But in terms of the status of the bill, Yee's decision has no immediate effect."

The senator was originally named by the Half Moon Bay City Council as a co-author of AB 1991 - the legislation that would deliver Beachwood development rights to Charles Keenan in exchange for dropping his claim to a $40-million judgment. According to the settlement agreement, if the city is unable to allow Keenan to develop the Beachwood property, it must pay him $18 million plus interest.  The city has already agreed to the settlement.

On Thursday, Yee's office confirmed that the senator had decided to withdraw from co-authoring AB 1991, citing financial and environmental doubts about the bill.

Mullin says that both himself and Yee wanted to help the council reach a settlement, but neither of them were informed of the details of the negotiations.

According to Mullin, AB 1991 is still being drafted. The assemblyman says his staff can write the legislation so that it does not set any legal precedent allowing other developers to circumvent state environmental laws.
